Weigh to GoThese Terms of Service ("Terms") are a binding agreement between you and Sprezza LLC ("Sprezza," "we," "us," or "our") governing your use of the Weigh to Go mobile application and related services (the "App"). By downloading, accessing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your country) to use the App. By using it, you represent that you meet this requirement and that the information you provide is accurate.
2. Your account
Some features require an account. You are responsible for keeping your login credentials confidential and for all activity under your account. Notify us promptly at legal@sprezza.io if you suspect unauthorized use. You agree to provide accurate information and to keep it up to date.
3. Acceptable use
You agree not to:
- Use the App for any unlawful purpose or in violation of these Terms;
- Attempt to access accounts, data, or systems that are not yours;
- Interfere with, disrupt, or place undue load on the App or its infrastructure;
- Reverse engineer, decompile, or attempt to extract the source code of the App, except where permitted by law;
- Copy, resell, or commercially exploit the App without our written permission.
4. Your data
The weigh-ins, goals, and other content you enter remain yours. You grant us a limited license to store, process, and display that content solely to operate and improve the App and provide it to you (for example, to sync across your devices and calculate trends). Our handling of your information is described in our Privacy Policy.
5. Purchases and subscriptions
The App may offer optional paid features or subscriptions. If it does, purchases are processed by the Apple App Store or Google Play under their terms, billed to your store account. Subscriptions renew automatically unless canceled, and you manage or cancel them through your store account settings. Except where required by law or the applicable store's policies, payments are non-refundable.
6. Intellectual property
The App, including its software, design, branding, and content (excluding the data you enter), is owned by Sprezza and protected by intellectual property laws. We grant you a personal, non-exclusive, non-transferable, revocable license to use the App for your own personal, non-commercial use, subject to these Terms.
7. App stores
Your use of the App is also subject to the terms of the store you downloaded it from (Apple App Store or Google Play). Those stores are not responsible for the App and are not parties to these Terms, though they may be third-party beneficiaries entitled to enforce them.
8. Termination
You may stop using the App and delete your account at any time. We may suspend or terminate your access if you violate these Terms or to protect the App and its users. Provisions that by their nature should survive termination (such as intellectual property, disclaimers, and limitations of liability) will continue to apply.
9. Disclaimers
The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that trends or calculations it shows are accurate for your individual circumstances.
10. Limitation of liability
To the fullest extent permitted by law, Sprezza will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising out of or relating to your use of (or inability to use) the App. To the fullest extent permitted by law, our total liability for any claim relating to the App will not exceed the greater of the amount you paid us for the App in the 12 months before the claim, or USD $50.
11. Changes to the App and these Terms
We may modify or discontinue features of the App at any time. We may also update these Terms from time to time; when we make material changes, we will update the "Last updated" date and, where appropriate, notify you in the App. Your continued use after changes take effect means you accept the updated Terms.
12. Governing law
These Terms are governed by the laws of the United States and the state in which Sprezza LLC is organized, without regard to conflict-of-law principles. Any disputes will be subject to the exclusive jurisdiction of the courts located there, unless applicable law requires otherwise.
